A legal settlement has been entered in the above consumer protection lawsuit. Grocery Delivery E-Services USA Inc., dba HelloFresh denies liability. This settlement requires Grocery Delivery E-Services USA Inc., dba HelloFresh to make certain changes to how it advertises automatically renewing product subscriptions on its website, www.hellofresh.com. The settlement also provides money to eligible California customers.

You are included in the settlement if all of these are true:

a)    You were enrolled in an Automatic Renewal Product Subscription any time between January 1, 2019, through August 18, 2025; and
b)    You were charged for the first shipment without your knowledge or consent; and
c)    You cancelled your Automatic Renewal Product Subscription after the first shipment; and
d)    You never received a refund for the above charge(s).

Subject to potential pro rata deduction pursuant to paragraph 26(b) of the Final Judgment and Injunction Pursuant to Stipulation, each Eligible Recipient in the Final List of Payees shall receive a complete refund of all amounts that were paid to Defendant prior to August 18, 2025.
 

The total cash restitution paid shall not exceed the amount of the Restitution Fund. If the amount of total valid cash claims by Eligible Recipients exceeds that amount, the per-person amount shall be reduced pro rata so that the total cash restitution equals that amount in the Restitution Fund. 

All Claim Forms will be reviewed by the Claims Administrator for completeness and plausibility. You must file a Claim Form to get money from the proposed settlement. Claim Forms must be submitted online by December 17, 2025, or postmarked no later than December 17, 2025. Defendant is ordered pursuant to California Business and Professions Code sections 17203, 17206, 17535, and 17536 to pay civil penalties, restitution, and investigative costs in the amount of $7,500,000.00 (Paragraph 6 of the Final Judgment and Injunction Pursuant to Stipulation, “Monetary Relief”).
